Terms of Service

Not a broker. Not investment advice. Momo Trading is day-trading software. We do not execute trades as your broker, custody funds, or provide personalized investment, tax, or legal advice. Brokerage services (if any) are provided by third parties you connect, such as Charles Schwab.

1. Agreement

These Terms of Service (“Terms”) are a contract between you and Momo Trading (“Momo,” “we,” “us”). By accessing momotrading.app, app.momotrading.app, creating an account, or purchasing a subscription, you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy, Disclaimer, and Cookie Policy.

2. The service

Momo provides software tools for market scanning, charting, order workflows, paper trading, and related features (“Service”). Features may change. We do not guarantee uninterrupted availability, market-data accuracy, or that any strategy or tool will produce profits.

3. Eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for complying with laws that apply to your trading activity and broker relationship.

4. Accounts

You must provide accurate account information and keep credentials secure. You are responsible for activity under your account. Notify us promptly of unauthorized use at support@momotrading.app.

5. Subscriptions & billing

Paid access is sold as a subscription (for example, a low-cost first week followed by a monthly plan). Prices and plan details are shown at checkout. Payments are processed by Stripe. Subscriptions renew automatically until canceled through the billing portal or as otherwise described in our Refund & Cancellation Policy.

6. Broker & third-party connections

If you connect a broker API (e.g., Schwab) or other third-party services, you authorize Momo to exchange data with those providers as needed to operate features you use. Your relationship with each third party is governed by their terms. We are not responsible for broker outages, rejects, fills, margin requirements, or account restrictions.

Paper trading is simulated. Results are not real trades and may differ materially from live market execution.

The Service, branding, and software are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service during an active subscription, subject to these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SEE ALSO OUR DISCLAIMER.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMO AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR TRADING LOSSES, LOST PROFITS, OR DATA LOSS. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM.

12. Indemnity

You will defend and indemnify Momo against claims arising from your use of the Service, your trading activity, your broker relationship, or your breach of these Terms.

13. Termination

You may cancel as described in the Refund & Cancellation Policy. We may suspend or terminate access for nonpayment, abuse, legal risk, or material breach.

14. Governing law

These Terms are governed by the laws of California, excluding conflict-of-law rules. Courts located in California will have exclusive venue, unless applicable law requires otherwise.

15. Changes

We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance. Material changes may also be communicated by email when practical.
